On January 1, 2014, the “Special Equipment Safety Law of the People’s Republic of China” was officially implemented.

Compared with the Regulations on Safety Supervision of Special Equipment, which was implemented for 10 years, the new law adds a product defect recall system, a special equipment scrapping system and a liability traceability system.

After the implementation of the “Special Equipment Safety Law”, if there are identity defects that endanger the safety of special equipment due to production reasons, the production unit shall immediately stop production and take the initiative to recall. At the same time, the responsibility traceability system established is to establish an “ID card” for special equipment. From the production, operation, use to scrapping of special equipment, the relevant responsible units must establish information files, and after a problem occurs, the regulatory department can trace the responsibility.

There is no time to delay in legislation

It is understood that special equipment is divided into eight categories of equipment, such as boilers, pressure vessels (including gas cylinders), pressure pipelines, elevators, etc., as well as other equipment stipulated by laws and regulations.

Liu Zhaobin, director of the Department of Regulations of the General Administration of Quality Supervision, Inspection and Quarantine of the People’s Republic of China, introduced that in 2005, the number of special equipment in the country was about 3 million units, and by last year, the total number had reached more than 8.2 million units. Taking elevators as an example, by 2013, the number of elevators has reached more than 2.5 million, which is the first in the world. The first urgent need for legislation is to deal with the regulatory problems caused by the surge in the number of special equipment. At the same time, the situation of safety production is grim and safety accidents occur from time to time, which also makes national legislation urgent.

On the whole, China’s special equipment supervision is effective and safe. The number of boiler and pressure vessel explosion accidents dropped from 7 per 10,000 units in 1979 to 0.5 per 10,000 units in 2002. During the “Eleventh Five-Year Plan” period, the number of deaths of 10,000 units of special equipment dropped from 0.94 in 2006 to 0.6 in 2012, but it was still 4~6 times higher than that of developed countries.

Still take the elevator as an example, the elevator is the closest and most needed special equipment from the people, we often need to take the elevator, especially in densely populated places.

The elevator boiler industry has laws to follow

Before the promulgation of the “Special Equipment Safety Law”, the special equipment supervision department could not supervise the operators of special equipment such as elevators and boilers, even if the operators may sell products that do not meet the requirements of special equipment management, but the law enforcement personnel cannot follow.

The general provisions of the “Special Equipment Safety Law” clarify the production, operation, use, inspection, testing and supervision and management of special equipment, of which the business link is newly added on the basis of the “Regulations”.

The sales, leasing and import of special equipment are regulated, so that the supervision of special equipment forms a more complete chain and is further connected with the legal system of product quality. If the law clearly stipulates that the seller shall establish a purchase acceptance and sales record system, and shall not sell special equipment that does not meet the statutory requirements without permission, inspection or national elimination.

After the implementation of the “Special Equipment Safety Law”, if there are identity defects that endanger safety due to production reasons such as boilers and elevators, the manufacturer must immediately stop production and take the initiative to recall.

The “Special Equipment Safety Law” requires enterprises to establish a complete file management system, and the entire life cycle of special equipment has corresponding safety information records, and product quality responsibility and use management responsibility can be traced. If the special equipment recall conditions are met, the enterprise shall take the initiative to recall; If the company does not take the initiative to recall, the government department has the right to force the recall. The person in charge said that the implementation of the recall system for special equipment will further strengthen the sense of responsibility of the production unit and help improve the product quality of special equipment. The “Special Equipment Safety Law” requires enterprises to establish a complete file management system, and the entire life cycle of special equipment has corresponding safety information records, and product quality responsibility and use management responsibility can be traced. If the special equipment recall conditions are met, the enterprise shall take the initiative to recall; If the company does not take the initiative to recall, the government department has the right to force the recall. The person in charge said that the implementation of the recall system for special equipment will further strengthen the sense of responsibility of the production unit and help improve the product quality of special equipment.
